Wills, Personal Directives, and Power of Attorney

Estate planning is essential to ensure that your loved ones are protected upon your death. There are 3 documents to effective Estate planning:

1. Last Will and Testament:

A Will is a direction for the distribution of your property and the appointment of a Guardian for your minor children upon your death. It ensures that all members of your family are treated fairly and that the appropriate Executor is appointed to complete the administration of your Estate.

2. Enduring Power of Attorney:

An Enduring Power of Attorney gives authority to a person that you choose to manage your financial affairs, even if you become mentally incapacitated. An Enduring Power of Attorney can take effect either when it is executed or if you become mentally incapable of managing your affairs at some time in the future. An Enduring Power of Attorney is an effective means of ensuring that your financial affairs are protected if you lose mental capacity temporarily or on a more permanent basis.

3. Personal Directive:

A Personal Directive gives authority to a person that you choose to make personal and medical decisions on your behalf. A Personal Directive can only take effect if you become mentally incapable of managing your affairs. Appointing an agent pursuant to a Personal Directive ensures that your wishes for medical treatment are followed even if you become temporarily or permanently mentally incapable of expressing your wishes.

Applications under the Adult Guardianship and Trusteeship Act:

For an Adult dependent child who is not capable of managing their medical and financial needs or a loved one that has lost mental capacity, it is possible to be appointed their Guardian pursuant to the Adult Guardianship and Trusteeship Act for their personal and medical decisions and as a Trustee appointed pursuant to the Adult Guardianship and Trusteeship Act to manage their financial affairs. We can assist you with this process.

Small Claims

Small Claims Court is intended for people to be able to act for (represent) themselves without the assistance of a lawyer. However, lawyers are allowed to appear & represent clients there. A Legal Coach can help you explore options for resolution outside of the court process and then take steps to protect the clients' interests for the best outcome throughout the action.

Notary Public Services

We can act as a Notary Public to have you swear affidavits or statutory declarations on documents that you bring to your office or, where needed, we can draft the documents for you. We offer same day appointments where needed.

Commissioner for Oaths

We can act as a Commissioner for Oaths to have you swear affidavits or statutory declarations on documents that you bring to your office or, where needed, we can draft the documents for you. We offer same day appointments where needed.

Certified True Copy of a Document

We can notarize documents or make a certified true copy on a walk in or same day basis. this is sometimes known as document verification or certification.

Identification Verification

Identification verification is usually used in the context of verifying your ID for profession standards exams. Learn more about the ID verification process and how we can help right away. Most often used for doctors, lawyers, accountants, engineers, dentists, etc. If you are not sure, please call and we can let you know if we can help.

Independent Legal Advice

Sometimes you will require independent legal advice (ILA). This lets someone know that you have met with a lawyer and learned your rights and obligations a particular situation or around a specific contract. This ensures that you cannot claim that you were not aware of what you were singing.
Examples:
  1. If a 3 page document requires 1 Notarization = $50 plus tax.
  2. If a 3 page document requires 3 Notarizations = $70 plus tax.
  3. If you require 1 "Guarantee Certificate" = $200 plus tax.

Landlord & Tenant Law

In Alberta, landlords and tenants have different places they can go to make an application. Landlords and tenants should seek legal advice if they do not know what to do.
